Acceptance of Terms

This site is owned and operated by Tony Walsh (referred to as "Owner"). Gloomveil.com, also referred to as "the site" or "this site" (URL: www.gloomveil.com and/or www.secretlair.com/gloom) is offered to You (referred to as "You" or "user") on the condition that You accept all of these terms of use. By using this site, You agree to abide by these terms. If You do not agree to these terms, please discontinue Your use of this site immediately.

Owner reserves the right to change these terms at any time by publishing a revised version of the Terms of Use on the site. You are responsible for regularly reviewing these terms. Continued use of the site following any such change means You accept and will abide by the change.

Restriction on the Use of Materials

All site, text, images, photographs, illustrations, audio clips, video clips, interactive applications, artwork, graphic material, or other copyrightable elements, and the design, selection and arrangements thereof, and trademarks, service marks and trade names (the "materials") are the copyrighted property of Owner unless otherwise noted. Gloomveil is a trademark of Owner. All other trademarks are the property of their respective owners.

User-Created Content

If You post and/or upload information, text, code, or images ("Postings") in any bulletin board, discussion, or other forum within the site, You agree not to use language that is threatening, abusive, vulgar, discourteous or criminal. You also agree not to make Postings or otherwise transmit information or materials that would violate rights of any third party or which contain a virus or other harmful component. The bulletin boards, discussion areas, or other venues on this site are for Your noncommercial use only. Users may not make Postings of any information intended to promote and/or generate revenue for any third party business activity.

You hereby authorize Owner's use of Your Postings on this site in whole or in part, alone, or together or as part of other material of any kind or nature. Without limiting the foregoing, Owner will have the right to use, change, and delete the Postings at any time and without notice.

You agree that the content in Your Postings and/or Submissions to this site shall not infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; and shall not violate any law or regulation.

You will always be credited for your work. Your contact and other information will be displayed. Here is the existing Contributors' List. If a complete work is used, you will be credited as the author. If your work is used in part, you will be credited as co-author or contributor to a complete work. You can continue to use the Postings and/or Submissions even after You send them to Owner, so long as You either own the content yourself or the person owning the content gave You the right to use it.

 

Advertisements

You acknowledge and agree that Owner runs advertisements on this site, including pages of this site that contain Postings and/or Submissions. These advertisements may include, without limitation, "banner" advertisements and "pop-up text" advertisements. The manner, mode, and extent of such advertising is subject to change.

The site contains links and other pointers to Internet sites maintained by third parties. Owner does not operate or control, or necessarily endorse the content found on such third-party sites.

 

Indemnification

You agree to indemnify and hold harmless Owner and third parties assisting in the operation of the site from any claims, liabilities, and expenses (including reasonable attorney's fees) that may arise from Your use of the site in any way or from Your breach of the terms of this Agreement.

Term and Termination

This Agreement is effective until terminated by Owner for any reason, with or without notice. Upon any termination of this Agreement, You agree to discontinue Your use and access of the site and immediately destroy all materials obtained from it.

Governing Law

This agreement will be governed by and construed in accordance with the laws of the Province of Ontario (Canada). You agree you are subject to personal jurisdiction in all courts and venues in Ontario, and waive any jurisdictional or inconvenient forum objections to such jurisdiction.

USE OF THIS SITE IS UNAUTHORIZED IN ANY JURISDICTION THAT DOES NOT GIVE FULL EFFECT TO ALL PROVISIONS OF THIS AGREEMENT, INCLUDING WITHOUT LIMITATION THIS PARAGRAPH AND THE WARRANTY DISCLAIMERS AND LIABILITY EXCLUSIONS ABOVE.

If any part of this agreement is invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall govern such use.

Miscellaneous

Owner reserves the right to make any and all changes to the Site at his sole discretion without notice to users. Owner reserves the right to deny access to the Site to anyone at any time, and to terminate this Agreement at any time without notice in his sole discretion.

This Agreement constitutes the entire agreement between You and Owner.

Any rights not expressly granted herein are reserved to Owner.
